These terms and conditions apply to orders placed through Road to 180 Darts and the website roadto180darts.com. By placing an order, the customer agrees to these terms and conditions insofar as they do not conflict with mandatory consumer law.
1. Scope
These terms and conditions apply to every offer, order and agreement between Road to 180 Darts and a customer who purchases a product through our online store.
Any deviation from these terms and conditions is valid only if agreed in writing with Road to 180 Darts.
2. Offers and product information
We make every effort to display products, prices, images and product information as clearly and accurately as possible. Minor differences in colour or appearance may occur as a result of screen settings.
If a product is unexpectedly unavailable or there is an obvious error in the price or product information, we will contact the customer as soon as possible.
3. Formation of the agreement
An agreement is formed when the customer places an order and Road to 180 Darts confirms the order electronically.
We reserve the right to refuse an order where there is a reasonable basis for doing so, for example in the event of obvious errors, misuse or payment problems.
4. Prices and payment
All prices in our online store are shown including VAT unless explicitly stated otherwise.
Any shipping costs are clearly shown before the order is completed.
Payment is made using the payment methods offered during checkout. The order can be processed once payment has been completed successfully.
5. Shipping and delivery
We aim to process and ship orders within the time period stated on our website. Delivery times are indicative unless a fixed delivery date has explicitly been agreed.
If delivery is delayed, we will keep the customer informed as well as reasonably possible. If no delivery period has been agreed, the statutory rules on delivery apply.
The customer is responsible for entering the delivery address correctly. Additional costs resulting from an incorrect or incomplete address may, insofar as permitted by law, be charged to the customer.
6. Cooling-off period and right of withdrawal
Consumers making an online purchase generally have the statutory right to withdraw from the agreement within 14 days after receiving the product without giving a reason.
Within this period, the customer can notify us that they wish to cancel the purchase using the available withdrawal function on the website, the return form or by sending a clear statement to roadto180darts@hotmail.com.
After withdrawal, the customer generally has a further 14 days to return the product.
7. Returns after withdrawal
For a standard return within the statutory cooling-off period, the direct cost of returning the product is borne by the customer, provided this was clearly communicated before purchase.
The customer may inspect and assess the product as they would be permitted to do in a physical store. If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, the customer may be liable for any reduction in value.
In the event of a full withdrawal, we will refund the purchase price and, where applicable, the cost of the least expensive standard delivery option offered. The refund will be made within the statutory period and using the same payment method unless the customer agrees to another method. We may wait to issue the refund until we have received the product or until the customer provides proof that the product has been returned.
8. Exceptions to the right of withdrawal
The right of withdrawal does not apply where the law provides an exception, for example for products made specifically to the customer's requirements or personalised products. Where an exception applies, this will be clearly stated before purchase.
9. Defective or incorrectly delivered product
The customer is entitled to a product that meets what may reasonably be expected of it and the information provided at the time of sale.
If a product is damaged, defective or delivered incorrectly and this was not caused by improper use by the customer, we will provide an appropriate solution at no cost to the customer. Depending on the circumstances, this may involve repair, replacement, a price reduction or a refund.
Costs necessary to resolve a valid warranty or conformity issue, such as necessary return shipping costs, will not be passed on to the customer.
10. Statutory warranty
Our products are covered by the statutory warranty. In the Netherlands, statutory warranty does not have a fixed standard period: a product must continue to function properly for as long as the customer may reasonably expect, taking into account factors such as the type of product, the price, its characteristics and the information provided.
Damage caused by incorrect or improper use, normal wear and tear or damage caused by the customer is not covered by the statutory warranty.
11. Complaints
Do you have a complaint about an order or product? Contact us as soon as possible at roadto180darts@hotmail.com and include, where available, the order number and a clear description of the problem.
For a damaged or defective product, we may ask for clear photos so that we can assess the issue. This does not limit the customer's statutory rights.
We aim to respond substantively to complaints within a reasonable period and work together to find an appropriate solution.
12. Liability
Road to 180 Darts is not liable for damage resulting from incorrect, improper or unintended use of a product.
Nothing in these terms and conditions limits or excludes liability where doing so is not permitted under mandatory law.
13. Intellectual property
All texts, designs, images, logos, training concepts and other content of Road to 180 Darts are protected by applicable intellectual property rights insofar as those rights belong to Road to 180 Darts or its licensors.
These materials may not be copied, distributed or used commercially without prior permission.
14. Changes to these terms and conditions
We may amend these terms and conditions from time to time. The terms and conditions in force at the time an order was placed apply to that order unless a change is required by law.
15. Governing law and disputes
Agreements with Road to 180 Darts are governed by Dutch law insofar as mandatory consumer rules in the country where the consumer resides do not provide otherwise.
In the event of a dispute, the parties will first try to reach a solution together. Consumers' statutory rights and the jurisdiction of competent courts remain fully applicable.
